1. Acceptance of Terms

By accessing or using BlueGum Horizon ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform constitutes your acceptance of these Terms and any amendments thereto.

2. Platform Description

BlueGum Horizon is a free browser games entertainment platform with a playful toy landscape theme. The Platform offers casual browser games, including but not limited to Toy Match, Color Spin, Block Memory, Daily Adventure, and Speed Tap. All games are provided solely for entertainment purposes. The Platform does not offer financial transactions, wagers, or prizes with real-world value. Points, scores, streaks, and in-game progress are purely for enjoyment and have no monetary or commercial value. The Platform is not a gambling service and is intended exclusively for leisure and entertainment.

3. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, games, software, and design elements, is the property of BlueGum Horizon or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Platform without our prior written consent. You are granted a limited, non-exclusive, revocable license to access and use the Platform for personal, non-commercial entertainment purposes only.

4. User Conduct

You agree to use the Platform lawfully and respectfully. You must not: (a) attempt to reverse-engineer, decompile, or extract source code from the Platform or its games; (b) use automated systems, bots, or scripts to access or interact with the Platform; (c) interfere with or disrupt the Platform's operation or security; (d) use the Platform for any illegal purpose or in violation of any applicable laws; or (e) harass, abuse, or harm others through the Platform. We reserve the right to restrict or terminate access for any user who violates these terms.

5. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. All games and content are for entertainment only. We disclaim any liability for decisions made or actions taken based on information or content provided through the Platform.

6. Limitation of Liability

To the fullest extent permitted by law, BlueGum Horizon, its operators, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform. Our total liability shall not exceed the amount you paid to use the Platform (which is zero, as the Platform is free). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such cases, our liability is limited to the maximum extent permitted by law.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of New Zealand.

We may modify these Terms at any time. We will endeavour to notify users of material changes by posting updated Terms on this page and updating the "Last updated" date.
